المحكمة العسكرية تصدر حكما ببراءة ثلاثة عمال وحبس خمسة مع ايقاف التنفيذ المنظمات الموقعه تطالب بإلغاء التعديل 138 لسنة 2010
أصدرت المحكمة العسكرية حكمها فى القضية 76 لسنة 2010 جنايات عسكرية غرب القاهرة الخاصة بعمال مصنع حلوان للصناعات الهندسية (99 الحربى سابقا) حيث قضت المحكمة ببراءة جميع العمال من تهم التعدى بالضرب على رئيس مجلس الادارة، والإضراب عن العمل، وافشاء أسرار عسكرية ، وقضت بحبس كلا من أيمن طاهر وأحمد طاهر سنة وغرامة ألف جنية مع ايقاف تنفيذ العقوبة لمدة ثلاث سنوات وذلك عن تهمة اتلاف مال عام ، كما قضت بحبس أحمد عبد المهيمن، ومحمد طارق قرنى وعلى نبيل عزت بالحبس ست شهور والف جنيه غرامة عن تهمة اتلاف مال عام مع إيقاف تنفيذ العقوبة، وبراءة باقى المتهمين وهم طارق سيد محمود، ووائل بيومى محمد وهشام فاروق عيد من جميع التهم الموجهة إليهم .
يُذكر أن الإتهامات التى كانت موجهة لسبعة من العمال وهم (المتهم الأول/ أيمن طاهر حسن، المتهم الثانى/ أحمد طاهر حسن، المتهم الثالث/ أحمد محمد عبد المهيمن، المتهم الرابع/ محمد طارق سيد، المتهم الخامس/ وائل بيومى محمد، المتهم السادس/ هشام فاروق عيد، المتهم السابع/ على نبيل عزت ) من واقع أوراق القضية أنهم أتلفوا عن عمد بعض أجزاء مصنع 99 الحربى بأن قاموا بتحطيم بعض معامل الورش والمصنع، وكذا تحطيمهم لبعض المبانى به مما تسبب عنه إحداث التلفيات التى قدرتها جهات الإختصاص بالمصنع بمبلغ 126440 جنيها (مائة وستة وعشرون ألف وبعمائة وأربعون جنيها) ..وكذلك امتنعوا عمدا عن أداء العمل المكلفين به بمصنع 99 الحربى لمدة 3 أيام مما لحق بالمصنع الأضرار الموصوفة بالأوراق من جراء تعطل خط إنتاج الاسطوانة التى قدرتها جهات الاختصاص بالمصنع بمبلغ 16920000 جنيها (مليون وستمائة اثنين وتسعين ألف جنيها ) ..وتعدوا على أحد الموظفين العموميين اللواء /محمد أمين رئيس مجلس الادارة بأن قاموا جميعهم بإلقاء بعض القطع الحديدية الناتجة عن انفجار اسطوانة الغاز عليه أثناء تفقد حالة مصنع 99 الحربى للوقوف على أسباب حدوث انفجار اسطوانة الغاز.
بينما كانت الاتهامات الموجهة للمتهم الثامن ( طارق سيد محمود ) أنه أذاع سرا من أسرار الدفاع عن البلاد وهو بعض الأخبار والمعلومات المتعلقة بمصنع 99 الحربى التابع للقوات المسلحة عن طريق اتصاله بموقع إخوان أون لاين على شبكة المعلومات العنكبوتية (الإنترنت) وإفشاءه لما له مساس بالشئون العسكرية دون أن يصدر له إذن كتابى من القيادة العامة للقوات المسلحة بنشره أو إذاعته ..
كان العمال الثمانية قد تم التحقيق معهم عقب الإنفجار الذى تم يوم 3 أغسطس الجارى والذى تلاه احتجاجات عمالية اعتراضا على مقتل زميلهم وإصابة آخر ، وقررت النيابة العسكرية استمرار حبسهم بداية من يوم 14 أغسطس، وأعلنتهم بقرار الإحالة للمحاكمة فى 21 أغسطس ، وعقدت المحكمة خمس جلسات للمحاكمة كانت أولها جلسة الأحد الموافق 21 أغسطس، والثانية جلسة الأربعاء 25 أغسطس لتمكين الدفاع من الإطلاع على القضية بعد أن رفضت التصريح للدفاع بالحصول على صوره منها، وكانت الثالثة جلسة السبت 28 أغسطس لسماع ومناقشة الشهود، ثم الجلسة الرابعة يوم الأحد 29 أغسطس لمرافعات الدفاع، بالإضافة لجلسة اليوم الاثنين 30 أغسطس للنطق بالحكم .
ومن الجدير بالذكرأن هذه المحاكمة تعد ثانى محاكمة للعمال المصريين أمام المحكمة العسكرية بعد محاكمة خميس البقرى فى عام 1952 .
وقد تم إحالة العمال للمحاكمة أمام المحكمة العسكرية استنادا لتعديل تشريعى صدر فى نهاية شهر يونيه من هذا العام وبموجبه أضحت بعض الجرائم فى قانون العقوبات إذا ارتكبها أحد العاملين بالانتاج الحربى أو ضده أيا كان المكان الذى ارتكبت فيه من اختصاص القضاء العسكرى، وكما جعل جميع الجرائم التى تقع على أراضى ومنشآت والآت ومعدات ومهمات وادوات وأموال ووثائق الإنتاج الحربى وأى شيىء يتعلق بها من اختصاص القضاء العسكرى أيضا وهو التعديل 138 لسنة 2010 بتعديل بعض أحكام القانون 234 لسنة 1959 فى شأن قواعد خدمة الضباط الاحتياط بالقوات المسلحة وقانون القضاء العسكرى الصادر بالقانون 25 لسنة 1966 .
ومن مخاطر هذا التعديل أنه لم يقتصر فقط على مصانع الإنتاج الحربى لكنه جعل الجرائم التى تقع على المناطق المتاخمة للحدود والتى يصدر بتحديدها قرار من رئيس الجمهورية من اختصاص القضاء العسكرى ، وقد أصدر رئيس الجمهورية قراره رقم 204 لسنة 2010 وشمل العديد من المناطق وهو ما يعد توسعا فى إحالة المدنيين للمحاكمات العسكرية .
وإذ تطالب الجهات الموقعه على هذا البيان بالغاء التعديل 138 لسنة 2010 وايقاف العمل بالقرارات الادارية المنفذه له فإن هيئة الدفاع تصدر اجراءات الطعن على الأحكام الصادرة بحق الخمس عمال رغم إيقاف تنفيذها.

What i find difficult is to find a blog that can capture me for a minute but your blog is different. Bravo.
The new Zune browser is surprisingly good, but not as good as the iPod’s. It works well, but isn’t as fast as Safari, and has a clunkier interface. If you occasionally plan on using the web browser that’s not an issue, but if you’re planning to browse the web alot from your PMP then the iPod’s larger screen and better browser may be important.

However I’ve often been wondering: when does localization go so far that it becomes censorship? Aren’t these changes killing some of the game’s fun?
In order to illustrate my thoughts, Yakuza 3 on PS3 shows well how thin the frontier between censorship and localization can be. Almost immediately, it came under fire for the huge cuts it suffered at the hands of Western localizers. Apparently, a significant chunk of the cut scenes, minigames, and events were removed from the US release, deemed “inappropriate” for American audiences.
This gets me wondering: how much of the cut content was actually “inappropriate for American audiences” as in “cultural differences would prevent full understanding and therefore only serve to confuse the player and impede their progress”, as opposed to “Americans are generally far more religious and uptight than Japanese people, so we can’t show them this kind of nudity and/or violence”? I assume that someone purchasing the third installment in a game series would normally have a pretty good idea as to what kind of content they were getting into, especially with a series such as Yakuza, which is relatively well-known. The games even receive ratings similar to films, giving the consumer an even better idea of what the game in question contains.
Most of gamers are reasonable adults who just want to enjoy the game as it is, instead of playing an edited, censored version of it. So please, developers, think of gamers first when you are localizing your games.
Game localization shall always be respectful of gamers.
